The Association testified on several pieces of legislation related to data privacy, AI, biometric data and geo-location urging the Committee to recognize the banking industry’s strong privacy and data security standards and consumer protections and include an exemption for financial institutions as provided by Title V of the federal Gramm-Leach-Bliley Act (GLBA). The Association testified to oppose legislation that would establish a judicial foreclosure system in Massachusetts. In part, the bill would allow every borrower in Massachusetts to contest a pending foreclosure before a judge, which would add considerable cost and burden to local banks. The legislation also gives judges broad authority to modify the underlying mortgage or “grant any other appropriate relief,” which would be a significant increase in judicial power in Massachusetts and create uncertainty both for banks that hold mortgages in their portfolios as well as those loans that are sold into the secondary market. The Association and our members have been longstanding proponents of implementing financial literacy and personal finance curriculum throughout Massachusetts public schools. Last week, the Association submitted a comment letter to the Board of Elementary and Secondary Education urging the Board to consider implementing such curriculum as a requirement for Massachusetts students to graduate from high school.
